| Buying a home abroad is very different
from the UK, in Spain for example, contracts to purchase/sell
home are validated by a notary public when they become
public deeds- this process only creates a valid transfer
of the home to the purchaser.
Many estate agents offer this service to purchasers saying
all legal work undertaken.
This is not a substitute for having your own lawyer carrying
out all the necessary pre-contract enquiries as debts
on a home if not settled pre sale will automatically
be passed to the new owner.
If you are buying an unfinished new build often termed
off plan resale, the home will not become yours until
it is completed and the necessary certificates issued
e.g. Licencia de Primera Ocupación, first occupancy
license, without this your new home would be impossible
to resale but incredibly many people have purchased homes
without this in place and subsequently have appeared in
TV programs such as holiday homes from hell.

These problems would not occur if you were to use independent
English speaking lawyers, most people would not dream
of buying a house in their own country without consulting
a solicitor, when purchasing abroad it makes even more
sense.
